Welcome to dtodoconpablito.com. These Terms of Service govern your access to and use of our website, products, communications, and related services.

By accessing our website, placing an order, or purchasing a product, you agree to these Terms of Service, our Shipping Policy, and our Refund & Return Policy.

Throughout these Terms, “D’ todo con P@blito,” “we,” “us,” and “our” refer to D’ todo con P@blito LLC.

2. Eligibility

You must be at least 18 years old or have the authorization and supervision of a parent or legal guardian to make a purchase through our website.

By placing an order, you represent that the information you provide is accurate, complete, current, and authorized.

3. Products We Sell

We sell mobile phones, iPads, tablets, AirPods, electronic devices, cases, screen protectors, chargers, charging cables, replacement parts, and other accessories from various brands.

Unless expressly stated otherwise, all phones sold through our website are offered exclusively in Open Box – Like New condition.

4. Open Box – Like New Condition

Open Box – Like New means that the phone is not being sold as a factory-sealed product.

The phone may have been removed from its original sealed packaging, opened, activated, inspected, tested, handled, or prepared for resale before being offered for purchase.

Every Open Box – Like New phone:

  • Is fully functional when inspected and listed.

  • Has an appearance comparable to a new phone.

  • Has no noticeable signs of ordinary use.

  • Is carefully inspected and tested before being offered for sale.

  • Includes its original box.

  • Has a Battery Health percentage of 90% or higher.

  • Has its applicable Battery Health percentage displayed before purchase.

  • Includes any additional accessories identified in the product listing.

Open Box – Like New does not mean factory sealed, never opened, or never activated.

Some Open Box – Like New phones may have received prior service directly from Apple at an Apple Store, as further explained below.

5. Original Box

Every phone sold by D’ todo con P@blito LLC includes its original box.

The original box may have been opened and may show minor handling, storage, shipping, label, or packaging wear. Wear affecting only the box does not mean that the phone itself is defective.

Customers should preserve the original box during the applicable 30-day return period because it must be included with an eligible return.

6. Battery Health

Every Open Box – Like New phone will have a Battery Health percentage of at least 90% when it is inspected and listed for sale.

The Battery Health percentage applicable to the selected phone will be displayed in the product listing, product option, or other information presented before the customer completes the purchase.

The displayed percentage may be 90%, 91%, 95%, 100%, or another disclosed percentage of 90% or higher.

By completing a purchase, the customer acknowledges that they had an opportunity to review and accepted the Battery Health percentage displayed for the selected phone.

Battery Health measurements are generated by the applicable device operating system and reflect the available reading at the time of inspection. Battery Health may naturally decrease after delivery because of:

  • Normal use

  • Charging cycles

  • Charging habits

  • Temperature

  • Software updates

  • Device settings

  • Natural battery aging

A normal reduction in Battery Health after delivery is not automatically considered a covered defect.

An undisclosed battery malfunction, charging defect, unexpected shutdown issue, or materially inaccurate Battery Health disclosure reported within the applicable 30-day period may be evaluated under our Refund & Return Policy.

7. Apple Service and Repair History

Some Open Box – Like New phones may have previously developed a component or hardware issue before being offered for sale.

Whenever a phone sold by D’ todo con P@blito LLC has received a prior repair or component replacement, that service was performed directly by Apple at an Apple Store.

D’ todo con P@blito LLC does not open, disassemble, internally repair, modify, refurbish, solder, replace components in, or perform hardware work on the phones offered for sale through our website.

We do not install third-party, aftermarket, salvaged, or unauthorized parts in the phones we sell.

A phone serviced directly by Apple may display parts and service history information in its operating system, such as:

  • Genuine Apple Part

  • Genuine

  • An identified repaired or replaced component

  • A date associated with the completed service

  • Other Apple-generated service information

This information may appear when Apple previously replaced or serviced a component such as:

  • Battery

  • Display

  • Camera

  • Logic-board-related component

  • Another eligible component

The presence of Apple Parts and Service History does not, by itself, mean that the phone is currently defective.

A phone that has been serviced directly by Apple may still qualify as Open Box – Like New when:

  • The Apple repair has been completed.

  • The phone is fully functional.

  • The repaired component operates correctly.

  • The phone passes our inspection and testing.

  • The phone meets our Open Box – Like New cosmetic standards.

  • Its Battery Health is 90% or higher.

  • Its original box is included.

Any representation that a phone was repaired by Apple is based on the Apple service information, documentation, device records, or other reasonably verifiable information available to us.

A completed Apple repair does not mean that the phone was repaired, opened, or altered by D’ todo con P@blito LLC.

8. Inspection by D’ todo con P@blito LLC

Although we do not open or internally repair the phones, we inspect and test their externally accessible functions before offering them for sale.

Our inspection may include testing or reviewing:

  • Power and startup

  • Display operation

  • Touchscreen operation

  • Cameras

  • Speakers and microphones

  • Charging

  • Buttons

  • Wi-Fi and Bluetooth

  • Cellular functionality when reasonably available

  • Battery Health

  • Storage capacity

  • Carrier or lock status

  • Serial number or IMEI

  • Apple Parts and Service History when available

  • General cosmetic condition

Inspection and testing do not involve opening or disassembling the phone.

9. Other Electronic Devices

For iPads, tablets, AirPods, and other electronic devices, the applicable product listing will identify the available condition, packaging, battery information, included accessories, and other material characteristics when relevant.

Customers must review the individual product listing before completing a purchase.

10. Product Descriptions

We make reasonable efforts to provide accurate information about each product.

Depending on the product, its listing may specify:

  • Brand and model

  • Storage capacity

  • Color

  • Carrier compatibility

  • Unlocked or carrier-specific status

  • Battery Health

  • Included accessories

  • Packaging

  • Relevant technical specifications

  • Other material characteristics

Customers are responsible for reviewing the complete product listing and selecting the correct available options before purchasing.

The information displayed for the selected product at the time of purchase will apply to the order.

11. Product Images

Images displayed on the website are reference images intended to accurately represent the applicable model, design, color, and general appearance.

Unless expressly stated otherwise, product photographs may not show the exact individual unit delivered to the customer.

Minor differences involving labels, serial-number placement, box condition, screen content, or accessory arrangement may occur.

12. Included Accessories

Each phone includes its original box.

Any additional items included with the phone, such as a charging cable, charging adapter, documentation, or another accessory, will be identified in the applicable product listing.

Customers should not assume that an accessory is included unless it is specifically identified in the product listing or order confirmation.

13. Compatibility, Carrier Status, and Activation

Carrier compatibility, unlocked or carrier-specific status, and other relevant activation information will be identified in the product listing when applicable.

Customers are responsible for reviewing this information and confirming that the selected product is appropriate for their intended:

  • Wireless carrier

  • Service plan

  • Account

  • Region

  • Network

  • Intended use

We inspect and verify devices before listing them. However, we do not guarantee that every phone or device will work with every wireless carrier, service plan, account type, or geographic area.

A return caused by compatibility information that was accurately disclosed before purchase may be treated as a change-of-mind return.

14. Prices and Taxes

All prices are displayed in U.S. dollars unless otherwise stated.

Applicable sales taxes and other legally required charges may be calculated and displayed during checkout.

Prices displayed on product pages may not include taxes unless expressly stated.

We may update prices at any time. A price change will not ordinarily affect an order already accepted, except when an obvious pricing, typographical, technical, or inventory error has occurred.

15. Payments

Orders must be paid using a payment method available during checkout.

By submitting payment information, you represent that:

  • You are authorized to use the selected payment method.

  • The billing information is accurate.

  • You authorize us and our payment processors to charge the amount displayed during checkout.

We may request additional information to verify identity, payment authorization, billing information, shipping information, or suspected fraud.

16. Order Acceptance

Receiving an order confirmation does not necessarily mean that an order has been finally accepted or shipped.

We may refuse, hold, or cancel an order because of:

  • Product unavailability

  • An obvious pricing or description error

  • Inaccurate customer information

  • Incomplete shipping information

  • Payment failure

  • Failure to complete requested verification

  • Suspected fraud or unauthorized activity

  • Shipping restrictions

  • Unusual purchasing activity

  • Violation of these Terms

If we cancel a paid order before shipment, we will refund the canceled merchandise and any applicable charges.

17. Order Cancellations

Customers may request cancellation before an order has been processed or transferred to the shipping carrier.

A cancellation request is not guaranteed until it has been confirmed by us.

Once an order has been shipped, it cannot be canceled. It must be handled under our Refund & Return Policy after delivery.

18. Shipping

We currently ship only to eligible addresses within the United States.

A flat shipping charge of $14.99 per order applies unless the order qualifies for a free-shipping promotion or another shipping offer displayed during checkout.

Orders are generally processed and transferred to the shipping carrier within 1–3 business days.

After shipment, estimated carrier transit time is generally 6–10 business days.

Business days are Monday through Friday and exclude Saturdays, Sundays, and federal holidays.

Shipping and delivery dates are estimates rather than guaranteed dates.

19. Thirty-Day Return and Limited-Warranty Period

Eligible products have a 30-calendar-day return and limited-warranty period.

The 30-day period begins on the date the shipping carrier’s tracking information marks the package as delivered.

The customer must contact us within the 30-day period to request a return or report a covered problem.

20. Covered Functional Problems

Subject to inspection and the exclusions contained in our policies, covered problems may include:

  • Failure to power on

  • Undisclosed functional problems

  • Display defects not caused by the customer

  • Camera defects not caused by the customer

  • Nonfunctional buttons

  • Speaker or microphone defects

  • Charging-system defects

  • Undisclosed battery malfunctions

  • Receipt of a product materially different from the product ordered

  • Receipt of a phone with a materially lower Battery Health percentage than the percentage displayed for the purchased phone

  • Failure of a component previously repaired by Apple, when the failure was not caused by the customer or another excluded event

21. Excluded Problems

Coverage does not include:

  • Drops, impacts, dents, cracks, or broken screens

  • Water, liquid, moisture, or corrosion damage

  • Damage caused by incompatible, defective, or improperly used chargers or accessories

  • Repairs, opening, modifications, or part replacement performed after delivery by the customer or another third party

  • Password, Apple ID, Google Account, Samsung Account, activation, or carrier-account locks

  • Cosmetic damage occurring after delivery

  • Misuse, abuse, neglect, or improper storage

  • Loss, theft, or misplacement

  • Damage caused by inadequate return packaging

  • Normal battery aging or degradation after delivery

  • Customer-installed applications, software, settings, or modifications

  • Carrier incompatibility that was accurately disclosed before purchase

  • A Battery Health percentage that was accurately displayed and accepted before purchase

  • Minor handling or storage wear affecting only the original box

22. Apple Service History Is Not an Automatic Defect

A completed Apple repair or Apple-generated Parts and Service History message is not automatically considered a defect.

A return or warranty claim will not be approved solely because a functioning phone displays:

  • Genuine Apple Part

  • Genuine

  • A completed Apple service record

  • A previously repaired or replaced component

  • Another Apple-generated service-history notice

This does not prevent the customer from reporting an actual functional problem involving the Apple-serviced component during the applicable 30-day period.

23. Available Remedies

After receiving and inspecting a product, we may provide an appropriate remedy based on the circumstances.

Available remedies may include:

  • Repair through an appropriate service channel

  • Replacement with the same product

  • Replacement with a reasonably equivalent product

  • Store credit, with the customer’s agreement

  • Partial refund

  • Full refund

The remedy will depend on:

  • The nature and severity of the issue

  • Available inventory

  • Product condition

  • Repair availability

  • The difference between the ordered and delivered product

  • Applicable legal requirements

Store credit will not be the only remedy offered when a product is materially different from what was ordered, arrives damaged, or has a confirmed covered defect.

24. Change-of-Mind Returns

Eligible products may be returned within 30 calendar days after delivery when the customer changes their mind.

The product must be returned in substantially the same condition in which it was delivered and must include all originally supplied items, including:

  • The product

  • Original box

  • Included accessories

  • Included parts

  • Documentation

  • Promotional items

For a change-of-mind return:

  • The original $14.99 shipping charge is nonrefundable.

  • The customer is responsible for return shipping.

  • The customer is responsible for the return package until it is delivered to our authorized return address.

  • A refund may be reduced if the product or its included items have lost value.

We do not charge a fixed restocking fee when a product is returned complete and in substantially the same condition in which it was delivered.

25. Return Authorization

All returns require prior authorization.

We will provide return instructions and, when applicable, an authorized return label.

Products sent without authorization may be delayed, refused, or returned to the sender.

26. Account-Enabled Devices

Before returning a phone, iPad, tablet, AirPods, or another account-enabled device, the customer must:

  • Back up all desired data.

  • Remove personal information.

  • Remove SIM cards and memory cards.

  • Sign out of all accounts.

  • Disable Find My iPhone, Find My Device, or similar services.

  • Remove screen locks and passwords.

  • Remove Apple ID, Google Account, Samsung Account, activation, and carrier locks.

  • Reset the device when instructed.

A device that remains locked may be ineligible for a refund until the lock is removed.

We are not responsible for data left on a returned product.

27. Final-Sale and Nonreturnable Products

Except when defective, damaged upon arrival, incorrectly supplied, or otherwise required by law, the following may be nonreturnable:

  • Installed screen protectors

  • Installed replacement parts

  • Completed installation or repair services

  • Personalized or specially ordered products

  • Gift cards, when offered

  • Products marked Final Sale or As Is

  • Opened or used hygiene-sensitive products, including in-ear audio products

Any applicable final-sale designation will be disclosed before purchase.

28. In-Store Services and Repairs

We may offer diagnostics, repairs, installations, and other services at our physical location.

These separately requested customer repair services are distinct from the Open Box – Like New phones sold through our website.

Service availability, appointment information, pricing, parts, estimated completion time, and other details may be communicated through WhatsApp or another direct conversation.

Repair and in-store services may be governed by a separate Repair Service Policy, service authorization, estimate, work order, receipt, or written agreement.

29. Accuracy of Website Information

We make reasonable efforts to keep product information, availability, prices, and website content accurate.

Information may occasionally contain technical, typographical, photographic, inventory, or pricing errors.

We may correct errors, update information, or cancel an affected order. We will not materially substitute a different product without the customer’s agreement.

30. Prohibited Uses

You may not use the website:

  • For unlawful or fraudulent purposes

  • To submit false payment or identity information

  • To interfere with website security or operation

  • To transmit malware or harmful code

  • To impersonate another individual or organization

  • To misuse website content or intellectual property

  • To make knowingly false delivery, return, or payment claims

  • To return a substituted or different product

31. Intellectual Property

The website’s original text, graphics, branding, logos, layout, and other content are owned by or licensed to D’ todo con P@blito LLC and are protected by applicable intellectual-property laws.

Website content may be used only for personal shopping and informational purposes unless written permission is provided.

32. Third-Party Services

Our website may rely on third-party payment processors, shipping carriers, communications services, analytics platforms, and website providers.

Those services may have separate terms and privacy practices.

We are not responsible for third-party systems outside our reasonable control, except to the extent required by applicable law.

33. Disclaimer of Additional Warranties

Except for the express limited warranty described in these Terms and to the maximum extent permitted by law, products and services are provided without additional express or implied warranties.

Nothing in these Terms excludes a warranty, right, or remedy that cannot legally be excluded.

34. Limitation of Liability

To the maximum extent permitted by law, D’ todo con P@blito LLC will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from the use of the website or a product.

Our total liability for a claim relating to a purchased product will not exceed the amount paid for that product, except when a different remedy is required by applicable law.

This limitation does not apply to liability that cannot legally be limited or excluded.

35. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Subject to rights that cannot legally be waived, disputes relating to these Terms, the website, or a purchase will be handled by a court of competent jurisdiction serving Harris County, Texas.

36. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

37. Changes to These Terms

We may update these Terms periodically.

Updates will be posted on this page with a revised “Last Updated” date.

The terms in effect when an order is placed will generally apply to that order unless a change is required by law.
